HomeworkGenie ("we", "us", "our") is a WhatsApp-based homework solving service for Indian students in Grades 5 to 12. Our service is operated at homeworkgenie.in and delivered via WhatsApp at +91 7004603665.

This Privacy Policy describes what personal information we collect when you use our service, how we use it, who we may share it with, and what rights you have over your information.

By messaging HomeworkGenie on WhatsApp or using our website, you agree to the practices described in this Policy. If you do not agree, please discontinue use and contact us at privacy@homeworkgenie.in to request deletion of any data we may have collected.

2 Data We Collect

We collect the following categories of information:

During onboarding on WhatsApp, we ask you to share:

• Doubt content: The photos and text you send for homework help.
• Usage data: Number of doubts asked, timestamps, which subjects you seek help in most.
• Feedback signals: 👍 / 👎 ratings you give on answers.
• Subscription status: Whether you are on the free plan or a paid plan, and payment dates.

2.3 Payment Information

Subscription payments are processed via Razorpay. We do not store your card or UPI account details. Razorpay is PCI DSS compliant. We only retain a transaction reference ID and payment status for our records.

2.4 What We Do NOT Collect

• Government ID numbers (Aadhaar, PAN, Passport)
• Bank account details
• Health or biometric information
• Social media passwords or account credentials
• Precise GPS location (we only ask for your city)

3 How We Use Your Data

We use the data we collect for the following purposes:

3.1 Providing the Service

• Solving your homework doubts with AI, personalised to your class, board, and language.
• Delivering answers via WhatsApp within 60 seconds.
• Maintaining your doubt history so you can search and revise.
• Processing subscription payments and managing your plan.

3.2 Improving the Service

• Analysing anonymised doubt patterns to improve AI accuracy.
• Using your 👍 / 👎 feedback to retrain and improve answer quality.
• Identifying common weak areas across students to develop better content.

3.3 Communication

• Sending you your homework solutions and follow-up explanations.
• Sending subscription reminders, payment confirmations, and renewal notices.
• Daily study tips (opt-in, you can turn these off at any time).

3.4 Lead Generation (With Your Consent Only)

With your explicit prior consent collected during onboarding, we may use your profile data (name, phone, grade, board, city, subject) to connect you with educational companies that offer relevant courses and coaching relevant to your grade and goals.

This is described in full detail in Section 4 below.

4 Data Sharing with Educational Partners

4.1 What "Educational Partners" Means

Educational partners are verified, registered Indian educational companies that offer products or services relevant to your studies. This includes:

• Coaching institutes for Board exams, JEE, and NEET (e.g., Aakash, Allen, Physics Wallah)
• Online learning platforms (e.g., Vedantu, Unacademy, Doubtnut)
• Foundation course providers for Grades 5–9
• Subject-specific tutoring services
• Study-abroad and career counselling services for Class 11–12 students
• Local coaching centres in your city

We do not share your data with fintech apps, lending platforms, insurance companies, gambling or gaming apps, or any company that is not a registered educational service provider.

4.2 What Data Is Shared

When you consent to data sharing, the following information may be shared with educational partners:

• Your name
• Your WhatsApp phone number
• Your grade/class and board
• Your city
• Your primary subject interest (Math / Science / Both)

We do not share: your homework photos, the content of your doubts, your chat history, your payment information, or any sensitive personal data.

4.3 Non-Exclusive Lead Sharing

Your contact information may be shared with multiple educational partners simultaneously. This means more than one company may contact you. Each company that receives your information will have a legitimate educational offer relevant to your grade and subject.

If you find the volume of contact excessive, you can opt out at any time (see Section 5 and 6).

4.4 How Partners May Contact You

Educational partners may contact you via:

• Phone calls (from the partner's registered number)
• SMS
• WhatsApp messages (from the partner's WhatsApp Business account)

HomeworkGenie is not responsible for the content or frequency of communications from educational partners. If you wish to stop receiving communications from a specific partner, contact them directly or contact us and we will facilitate removal.

4.5 Consent Requirement

We will always ask for your explicit consent before sharing your data with any educational partner. During our onboarding process on WhatsApp, you will receive a message such as:

Only users who reply YES will have their data shared with educational partners. Users who reply NO will still receive all homework-solving features.

4.6 Third-Party Lead Platforms

We may use third-party lead distribution platforms (such as LeadSquared, Kenyt, or similar B2B services) to facilitate data delivery to educational partners. These platforms act as data processors on our behalf and are bound by data processing agreements consistent with this Privacy Policy and the DPDP Act 2023.

5 Your Consent

We collect consent for data sharing in a clear, affirmative manner. Silence, pre-ticked boxes, or inaction do not constitute consent.

Specifically:

• Homework solving: By messaging us on WhatsApp, you consent to us processing your message content for the purpose of solving your homework. This is required for the service to function.
• Educational partner data sharing: You must reply YES to our explicit consent request during onboarding. If you do not reply YES, your data is not shared.
• Marketing messages from HomeworkGenie: Sending us a message constitutes opt-in for service-related communications. You can opt out of promotional messages at any time.

You may withdraw any consent at any time. Withdrawing consent for educational partner sharing does not affect your ability to use the homework-solving service.

6 Opt-Out Instructions

You have multiple ways to opt out of data sharing:

6.1 Opt Out via WhatsApp (Easiest)

6.2 Opt Out via Email

Send an email to privacy@homeworkgenie.in with the subject line "Data Sharing Opt-Out" and include your registered WhatsApp number. We will process your request within 48 hours.

6.3 Request Full Data Deletion

To have all your data permanently deleted from our systems:

1. Email privacy@homeworkgenie.in with subject "Delete My Data"
2. Include your registered WhatsApp phone number
3. We will confirm deletion within 7 business days
4. Note: Once deleted, your doubt history cannot be recovered

6.4 What Happens After Opt-Out

• No new sharing of your data with educational partners from the opt-out date.
• We cannot recall data already shared before your opt-out. However, we will notify relevant partners that the lead should be suppressed where technically possible.
• Your service access (free or paid) continues unchanged.
• Historical sharing that occurred before opt-out is not reversed retroactively.

7 Data Retention

When data is due for deletion, it is permanently erased from our databases and backups within 30 days of the retention period ending.

8 Security

We take reasonable and appropriate technical and organisational measures to protect your personal data:

• WhatsApp end-to-end encryption: All messages exchanged via WhatsApp are encrypted by default by Meta's WhatsApp platform. We cannot read your messages outside of what you send us for solving.
• Database security: User data is stored on Supabase, which provides row-level security, encryption at rest, and SOC 2 Type II compliance.
• Access controls: Only authorised personnel can access user data, and only for the specific purpose of providing the service or resolving support issues.
• Payment security: Payment processing via Razorpay, which is PCI DSS Level 1 certified. We never store raw card or UPI credentials.
• Data minimisation: We collect only the data necessary for the purposes described in this Policy.

No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your data using commercially acceptable means, we cannot guarantee absolute security. In the event of a data breach that poses a risk to your rights, we will notify affected users within 72 hours as required by law.

9 Children's Privacy

HomeworkGenie is designed for students in Grades 5–12, which includes children under 18 years of age. We take the privacy of minors very seriously.

9.1 Parental Consent for Data Sharing

For students under 18 years of age, the consent for educational partner data sharing should be given by a parent or guardian. During onboarding, we encourage parents to review and respond to the consent request on behalf of their child.

If a minor provides consent on their own and a parent or guardian later requests withdrawal of that consent, we will honour the request immediately.

9.2 Sensitive Data Protections for Minors

• We do not knowingly collect data from children under 13 years of age without parental consent.
• We do not use data from minors for behavioural profiling, advertising targeting, or any purpose beyond educational service delivery and connecting with educational partners.
• Parents may request access to, correction of, or deletion of their child's data at any time by emailing privacy@homeworkgenie.in.

10 DPDP Act 2023 Compliance

HomeworkGenie processes personal data of Indian residents and is committed to compliance with India's Digital Personal Data Protection Act, 2023 (DPDP Act).

HomeworkGenie acts as a Data Fiduciary as defined under the DPDP Act. We determine the purpose and means of processing your personal data and are responsible for its protection.

Where we engage third parties (e.g., Supabase for database, Razorpay for payments, lead distribution platforms) who process data on our behalf, we ensure they operate under appropriate data processing agreements that meet DPDP Act requirements.

11 Your Rights

Under the DPDP Act 2023 and this Policy, you have the following rights:

• Right to Access: You can request a copy of all personal data we hold about you.
• Right to Correction: You can ask us to correct inaccurate or incomplete data.
• Right to Erasure: You can ask us to delete your personal data, subject to legal retention obligations.
• Right to Withdraw Consent: You can withdraw consent for data sharing at any time without affecting your service access.
• Right to Grievance Redressal: You can complain to us if you believe your data has been mishandled.
• Right to Nominate: You can nominate another individual to exercise your data rights on your behalf in the event of incapacity or death.

12 Refund Policy

We want you to be 100% satisfied with HomeworkGenie.

• 48-Hour Full Refund: If you are not satisfied with your subscription for any reason, request a full refund within 48 hours of payment. No questions asked. Send "REFUND" on WhatsApp.
• After 48 hours: Refunds are evaluated on a case-by-case basis. If the service was materially defective or unavailable, you are entitled to a pro-rated refund.
• Free Trial: No payment is taken during the free trial (3 doubts/day). No refund process is applicable.
• Refund Method: Refunds are issued to the original payment method (UPI, card) within 5–7 business days.

13 Terms of Use

13.1 Acceptable Use

HomeworkGenie is intended for genuine academic doubt-solving by students in Grades 5–12. By using the service, you agree to:

• Use it for legitimate homework and academic study purposes only.
• Not share or resell solutions from HomeworkGenie for commercial purposes.
• Not attempt to reverse-engineer, copy, or replicate the service.
• Not use the service to generate content that is harmful, illegal, or deceptive.

13.2 Service Availability

We aim for 99% uptime but do not guarantee uninterrupted availability. Scheduled maintenance, WhatsApp API outages, or third-party failures may cause temporary disruption. We will communicate planned downtime in advance via WhatsApp.

13.3 Accuracy Disclaimer

While we maintain over 95% accuracy through dual AI verification and human review, HomeworkGenie's solutions are intended as educational aids and should not be the sole basis for critical academic decisions. Always verify solutions with your teacher or textbook for exam preparation.

13.4 Subscription

Subscriptions renew automatically each month at the applicable rate unless cancelled. You may cancel at any time via WhatsApp. Cancellation takes effect at the end of the current billing period.

13.5 Governing Law

These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Jharkhand, India.
